When It Comes To Medical Malpractice Expert Witness Statements Carry Weight

By Debra Price

Medical malpractice is a very serious issue in the court of law. There are many cases in which gross negligence has caused the downfall of many healthy individuals that only had a minor health issue. These cases need to be moderated for context by a medical malpractice expert witness, in order for the correct course of action to be taken and justice to be served.

When a medical practitioner, such as a doctor or caregiver, fails to correctly dispense the care and treatment that the patient deserves, it is regarded as a breach of professional conduct. This act can be prosecuted and will be taken up by the patient's behalf. This is totally unacceptable because we expect doctors everywhere to be properly skilled in dispensing the correct medication to patients.

This can be devastating, because not only is the illness not treated, but an additional illness comes to root in the patient's body due to this negligence. It will take another few months for the patient to notice that they are not getting better, and sometimes when they go back and tell this to their respective doctors, their concerns are brushed aside and they are told that sometimes the symptoms will get worse before they get better.

This is a vicious cycle of abuse on the patient's health. Now the treatment process is put on hold indefinitely, and the doctor will only realise something is wrong if the patient seeks a second opinion from another health practitioner. The criteria for negligence is met when the patient's health declines due to the direct prescription by their doctor, or if the doctor prescribes medication based on only a few symptoms, without checking the health and disease of the patient rigorously.

Another factor that arises from malpractice is the added cost of a patient who needs to pay for all the treatment he received, and then take out more money to pay for the treatment that they originally needed. On top of that, they now need to pay for treatment that is made necessary by the ill-prescribed treatment that the doctor prescribed to them.

The expert witness will be the one that gets the case on track. He will provide expert testimony in order to convict the practitioner of his negligence, and provide the expertise to prove how the patient has suffered at the hands of the doctor. Due to an increase in the deaths of patients globally, and due to the leading cause being malpractice, it is safe to say that the testimony of these witnesses is very important.

Patients must rest assured, because these witnesses know what they are doing. They are fighting on the patient's behalf and the case will be won through professional testimony. Through careful examination of the facts, a conviction can be reached and the patient will be paid out or otherwise recompensed.

It should be brought to the court's notice if you suspect any malpractice. There are many expert witnesses who will be able to assist you. Recovering your health should be your first and only priority in order to live a fulfilling, enjoyable lifestyle.
